Talk to us about redundancy law and we will advise you on your entitlements and negotiate with your employer.

Redundancy

While most employees will face restructuring and redundancy during their working life, they often feel that the decision is personal and has little to do with genuine commercial needs and the law.

These concerns can be spurred on by a proposal to establish a new position that looks very similar to the position the employee holds or an employment relationship that has been tense for some time.

You are entitled under New Zealand law to be consulted before any decision to restructure is made and receive information that will allow you to have some real input. You are also entitled to be represented during this process.

How we can help

We will assist you by:

  • Advising you about the consultative steps your employer is required to take;
  • Advising you about the information you are entitled to receive.
  • Obtaining information that might allow you to challenge the restructuring proposal;
  • Representing you at meetings with the employer; and
  • Negotiating with the employer.

Please provide us with

  • A dateline of events.
  • A description of the issues for you.
  • Any witness statements you have obtained.
  • Your employment agreement and job description.
  • Letters, emails, and other relevant documents on the restructuring.
  • Pay slips.
  • Your contact details and those of the employer.
